Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the Walkerville Directory website and listing service (the "Service"), operated by Megan Schoeman ("we", "us", "the seller"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. The Service

The Walkerville Directory is an online directory of businesses and trades serving Walkerville, South Africa and surrounding areas. Businesses may submit a listing for review; approved listings are displayed publicly. Paid subscription plans (Standard and Featured) keep a listing visible after the initial free period and, in the case of Featured, give it priority placement.

2. Your account and listings

You must provide accurate information when creating an account and submitting a listing, and keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. If you submit a listing on behalf of a business, you confirm you have the authority to do so.

3. Acceptable use

You must not misuse the Service. In particular, you must not:

• use the Service for any unlawful purpose, or to post fraudulent, misleading or spam content;
• infringe the intellectual property or other rights of any person, including uploading images or logos you have no right to use;
• interfere with the security or operation of the Service, including introducing malware, probing or scanning for vulnerabilities, or scraping the site;
• attempt to reverse engineer, resell or redistribute the Service, or circumvent any technical limits.

You grant us a limited licence to host, display and process the content you submit (such as your business description and images) solely for the purpose of operating the directory.

4. Listing approval and moderation

All listings are reviewed before publication. We may approve, reject, edit or remove any listing at our discretion, including where content is inaccurate, unlawful, or outside the Walkerville area. Inclusion in the directory is not an endorsement of any business.

5. Payments and subscriptions

New listings include a free 30-day period. Thereafter, continued display requires a paid monthly subscription (Standard or Featured). Subscriptions renew monthly until cancelled. If payment is not made, the listing is removed from public display once the paid or free period ends.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms, in addition to these Terms.

6. Intellectual property

We retain all ownership of the Service and its intellectual property, including the website software, design, documentation and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your selected plan.

7. Service availability

We do not guarantee that the Service will be uninterrupted, timely, secure or error-free, and we may modify or discontinue parts of it at any time.

8. Warranties and liability

The Service is provided "as is". To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for any indirect, consequential or special damages (including loss of profits, data or goodwill). Our aggregate liability to you is capped at the fees you paid to us in the 12 months preceding the claim. Nothing in these Terms excludes liability for fraud, death or personal injury where such exclusion is not permitted by law. You indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

9. Suspension and termination

We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious violations of our policies. When your access ends, your listings are removed from public display; you may request a copy of your listing content within 30 days, after which it may be deleted.

10. General

These Terms are governed by the laws of South Africa, and the courts of South Africa have jurisdiction over any dispute. You may not assign these Terms without our consent; we may assign them in connection with a merger or acquisition. We are not liable for any failure to perform caused by events beyond our reasonable control. If any part of these Terms is unenforceable, the remainder continues in effect.
